Surprises can be great—except when it comes to medical bills. Congress recently passed a federal law that stops most unexpected medical bills and (surprise) the Tennessee General Assembly may follow suit. Just so you’re not caught off guard, the No Surprises Act is a federal law that seeks to stop most unexpected medical bills in situations where commercially-insured patients cannot meaningfully choose their provider or facility. But no surprise with any law involving ERISA and arbitration, it’s complicated. The No Surprises Act, which went into effect in January, generally applies to emergency care and scheduled care, but (no surprise) has some large exceptions and varies significantly by specialty. The Tennessee State Senate has also passed a similar bill, which the House needs to act on to become law.
